§ 54-1. Legislative intent.

It is hereby declared to be the policy of the Village of Saltaire that it is necessary to regulate the operation of water taxis and charter boats within the village and the waters adjacent thereto in order to better ensure the health and safety of the inhabitants of the village.

 

§ 54-2. Definitions.

As used in this chapter, the following terms shall have the meanings indicated:

OPERATOR - Any person who owns, controls, navigates,

directs or supervises a water taxi or charter boat.

WATERCRAFT -- A vessel used or capable of being used as a means of transportation in, over or upon water, including nondisplacement craft.

WATER TAXI or CHARTER BOAT -- A watercraft for hire, excluding watercraft owned or operated by any person or company providing regular ferry service to the village pursuant to a valid contract.

 

 

§ 54-3. Permit required.

No water taxi or charter boat shall land or pick up or discharge passengers within the village or the waters adjacent thereto without first having obtained a permit therefor issued by the Village. Applications for such permits shall be made on such forms and shall be accompanied by such fees as shall be determined from time to time by the Village and shall also be accompanied by all certificates of insurance, Coast Guard licenses and inspection certificates and any other documentation which may be required by this chapter or by resolution of the Board. All such applications shall be submitted at least thirty (30) days prior to the date for which permission to operate is sought. All fees shall be payable upon submission of an application for a permit, which fees shall be refunded in the event that such permit is denied. In the event of a violation of this or any chapter of this Code or of the conditions of any license or permit, the Board may revoke any permit issued in accordance with this section.

 

§ 54-4. Inspection of vessels.

Each water taxi or charter boat landing or picking up or discharging passengers within the village and the waters adjacent thereto shall be inspected according to the rules of the United States Coast Guard and shall have in effect at all times such license or licenses as the Coast Guard may require and shall also meet all other requirements of law.

 

§ 54-5. Boarding of vessels by authorized representatives.

The operator of a water taxi or charter boat, by applying for a permit from the Village, grants permission to any duly authorized representative of the Village to board any vessel or vessels to determine whether such vessel is in compliance with this chapter or with any other applicable laws, ordinances, rules or regulations promulgated by any jurisdiction, body or agency pursuant thereto.

 

§ 54-6. Insurance required.

A water taxi or charter boat permittee shall provide and maintain liability insurance and property insurance coverage in such amounts and written by such insurance companies as the Board shall from time to time determine by resolution. There shall be filed with the Village Clerk a certificate showing that said insurance is in force and effect. Failure to file such certificate within seven (7) days of the granting of a permit pursuant to this chapter shall result in the revocation of such permit. In every policy of insurance required hereby, the Incorporated Village of Saltaire shall be named as an insured. The naming of the Village as an insured shall in no manner be deemed an admission of any liability on the part of the Village.
