ARTICLE I
Restricted Use
§53-1. Title.
This Article shall be known as "Local Law Restricting Water Usage for Gardens, Plants, Shrubs and Grass."
§53-2. Legislative findings.
It is hereby found and declared that the unrestricted use of fresh water for the watering of gardens, p1ants, shrubs and grass is creating a hazardous condition affecting the public health, safety and general welfare of the people of the Village of Saltaire, in that such unrestricted use of fresh water unduly burdens the village’s water pumping and supply system and is ecologically unsound, and, therefore, this use of water should be subject to restriction and regulation as set forth herein.
§53-3. Outside watering restrictions.
During the period from the Friday before Memorial Day through September 15 of each year between the hours of 4:00 p.m. and 7:00 p.m. daily, no person shall use the fresh water of the village water system for the purposes of watering gardens, plants, shrubs or grass.
ARTICLE II
Backflow Preventer Devices
§ 53-4. Title.
This Article shall be known as "Local Law Requiring the Installation of Backflow Preventer Devices."
§ 53-5. Legislative findings.
It is hereby found and declared that, pursuant to the New York State Sanitary Code, the installation and utilization of various facilities or devices, including but not limited to automatic dispensing equipment, air-conditioning and refrigeration equipment using water as a cooling medium, swimming pools, hot tubs, automatic sprinkling systems and other devices having direct connection to the Village water system, may pose a hazard to the village water supply should any water backflow be returned to the village water supply system and that therefore backflow preventer devices shall be installed to prevent such hazard from occurring.
§ 53-6. Backflow preventer devices
§53-7. Inspection and installation.
A. All backflow preventer devices installed in accordance with this section shall be inspected annually, and not later than July 1 of each year by an approved inspector licensed by the New York State Health Department. Such inspections shall be paid for by the owner of the premises on which the device is located A copy of each annual inspection certificate is to be filed with the Village Building Inspector. Any violation of this section may subject the owner of said premises to the discontinuance of water service to the site, in addition to such penalties as may be provided by law.
B. The Building Inspector shall, upon determining that a backfiow preventer device is required at any premises within the village, serve or cause to be served notice upon the owner of such premises ordering the installation of an acceptable backflow preventer device. Failure to comply with such an order shall subject the owner to such penalties as may be provided by this Code or to the suspension of water service to the premises, or both.
ARTICLE III
Geothermal Heat Pumps
§53-8. Geothermal heat pumps.
A. It is prohibited to connect any geothermal heat pump to the village water system.
B. A geothermal heat pump shall be connected only to a privately owned and maintained supply and recharge well which has been inspected and approved in writing by the Suffolk County Health Department before the initial use of such a pump. A copy of all approvals and subsequent inspections by the Suffolk County Health Department shall be filed with the Village Building Inspector. Such inspections shall be made annually but on no account later than July 1 of each year. No geothermal heat pump shall be operated until copies of such inspection and approval are filed with the Building Inspector.
C. Failure to comply with the provisions of this section shall subject the owner of such pump to the suspension of water service to the premises, in addition to such other penalties as may be provided by this Code.
ARTICLE IV
Conservation of Water
§53-9. Title
This Article shall be known as "Loca1 Law Pertaining to the Conservation of Water in Emergencies."
§53-10. Legislative findings.
It is hereby found and declared that, during periods of drought or other emergency, the unregulated use of water may imperil village water supplies, and that it may become necessary in such circumstances for the Mayor to determine whether a water supply emergency exists and if so, to take appropriate measures to provide an adequate water supply for the village.
§ 53-11. Water conservation emergency.
Whenever the Mayor shall determine that a water supply emergency exists, he shall cause notice of same to be issued to every household and other establishments and post such notice within the village. The Board may by resolution adopt such restrictions on the use of water as it may determine are necessary for the duration of the emergency.
ARTICLE V
Inspections
§53-12. Inspections.
Upon reasonable notice, the Village Building Inspector shall be granted access to any premises within the village to assure compliance with this chapter.
